Terms of service
Version of 31 October 2026.
These terms govern access to the Digimo application (app.digimo.fr) and its use by real-estate professionals. They are entered into between DIGIMO, a French simplified joint-stock company (SAS), Immeuble Le Saint Seb 2, 17 rue Marie Curie, 44230 Saint-Sébastien-sur-Loire, France, RCS Nantes 833 742 331 (“Digimo”) and the legal entity or professional that opens a team (the “Customer”). Digimo is intended exclusively for professionals; it is not meant for consumers. The French version prevails in case of discrepancy.
1. Definitions
- Service: the Digimo application, its API, its connectors and this site.
- Team: an agency’s space in the Service, which holds its members and its dossiers. The Team is the contractual and billing unit.
- Member: a user attached to a Team, with a role: owner, administrator, agent or reader.
- Dossier: a property put up for sale, from the first document to the deed, with its documents, the facts read from them, its attention points and its reports.
- Credit: the right to open a Dossier.
- Party: a person outside the Team from whom a Member requests a document through a drop-off link: seller, syndic, notaire, diagnostician.
2. Purpose of the Service
Digimo collects the documents of a property sale, reads them, extracts facts tied to the page they come from, flags attention points, and writes reports from the dossier. The Service helps the Customer prepare a sale file; it replaces neither the Customer, nor the notaire, nor any other regulated professional (section 10).
3. Account and Team
The Customer creates a Team and owns it. It invites its Members and assigns them a role; it remains responsible for its Members’ use of the Service and for the confidentiality of their credentials. Each Member has a personal account, which they do not share. The Customer informs Digimo without delay of any unauthorised access.
A reader consults; an agent edits dossiers; an administrator also manages Members; the owner can do everything, including delete the Team. One Team’s dossiers are never visible to another.
4. Plans and prices
Prices are in euros, excluding VAT; VAT at the applicable rate is added.
| Plan | Price | Content |
|---|---|---|
| Pay as you go | €60 per Dossier | One Credit per Dossier, no subscription |
| Professional | €99 a month | 2 Credits included each month, €30 per additional Dossier |
| Network | On quote | Volume agreed with the Customer, assisted set-up |
The whole Team works on every Dossier: the number of Members is not billed, and no read, check or report carries an extra charge inside a Dossier. A new Customer’s first Dossier is complimentary (one welcome Dossier per Team owner).
Digimo may change its prices. A change applies to orders placed after its announcement and, for a running subscription, from the monthly period following one month’s notice.
5. Ordering, payment and invoicing
Online payment is not yet available: a plan is activated with Digimo, which credits the Team and issues an invoice. Invoices are payable within 30 days of their date, by bank transfer.
In case of late payment, penalties at three times the French legal interest rate are due as of right, as well as a fixed recovery fee of €40 (article L. 441-10 of the French commercial code). Digimo may suspend the opening of new Dossiers while a due invoice remains unpaid, without ever withdrawing access to existing Dossiers.
6. Dossier credits
- A Credit is consumed when the Dossier is opened, when it becomes active. It unlocks the whole Dossier: collection, reading, facts, checks, reports.
- Consumption is final: deleting or archiving a Dossier does not return its Credit.
- Credits bought pay-as-you-go do not expire. Credits included in the Professional subscription are granted each month on the subscription’s anniversary date.
- Credits are neither refundable nor transferable to another Team.
7. Term and termination
Pay as you go carries no commitment: the Customer pays for the Dossiers it opens. The Professional subscription is monthly, tacitly renewed, and may be cancelled at any time for the end of the current period, free of charge.
At the end of a subscription, no new Credit is granted; existing Dossiers stay accessible, with their history, and a new Dossier requires a Credit. The Customer may export its data at any time from the application and ask for its Team to be deleted, which is done within 30 days. Absent a request, the data of a Team whose contract has ended is kept for at most 12 months, then deleted.
Digimo may terminate the contract for a serious breach not remedied within 15 days of a formal notice, or on discontinuation of the Service with three months’ notice; in both cases the Customer is given time to export its data.
8. Customer’s obligations
The Customer is the controller of the data it places in its Dossiers, within the meaning of the GDPR. It warrants that it is entitled to upload each document, including the parties’ identity papers, and to have its content read by the Service in the course of its engagement; that it has informed the data subjects as the law requires; and that it uploads only what is useful to the sale. It alone decides to send facts to MyNotary, to link a Claude or ChatGPT connector, and to hand a report to a third party.
The Customer does not use the Service for an unlawful purpose, does not attempt to circumvent its protections, does not resell it, and does not prompt the analysis models outside the intended features.
9. Personal data — Digimo as processor
For Dossier data, Digimo acts as the Customer’s processor, under article 28 GDPR. As such, Digimo:
- processes that data only to provide the Service and on the Customer’s instructions, which follow from its use of the application, unless the law requires otherwise, and informs the Customer if an instruction appears to infringe the GDPR;
- keeps it confidential, and binds the persons authorised to access it to the same obligation;
- implements the security measures described in the privacy policy;
- uses only the sub-processors listed there, all in the European Union, and informs the Customer before changing or adding one, the Customer being then free to terminate;
- helps the Customer answer data subjects’ requests and meet its security and impact-assessment obligations, insofar as possible;
- informs it without undue delay of a personal-data breach;
- deletes or returns the data at the end of the contract, under section 7;
- makes available to the Customer what it needs to verify compliance with these obligations, and contributes to audits, including inspections, conducted by the Customer or an auditor it mandates, on terms agreed between them.
The subject matter, duration, nature and purpose of the processing, the types of data and the categories of data subjects are those described in sections 1 and 2 of the privacy policy; the duration is that of the contract, extended by the retention set in section 7.
For account, Team and billing data, Digimo is the controller; the privacy policy applies.
10. Artificial intelligence: scope and limits
The facts read, the attention points and the reports are produced by analysis models. They may be incomplete or wrong; that is why every fact points to the page it came from, and can be corrected. The Customer checks what it uses, and remains solely responsible for the advice it gives and the documents it hands over.
The Service provides no legal advice, no expert opinion, no diagnosis; it replaces neither the notaire, nor the diagnostician, nor the surveyor. The regulations it cites are given for information. An attention point is a signal to investigate, not a legal qualification.
11. Availability and changes
Digimo strives to keep the Service continuously accessible, without guaranteeing uninterrupted availability: maintenance, announced when planned, and incidents may interrupt it. The Service evolves; a feature may be added, changed or removed, without the Customer losing access to its Dossiers.
12. Intellectual property
The Service, its code, its report templates and its catalogue of checks belong to Digimo; the Customer receives a non-exclusive, non-transferable right of use for the term of the contract. Uploaded documents and the facts they contain remain the property of the Customer or of their holders. Reports written for the Customer belong to it; it may reproduce and distribute them under its name. Digimo does not use Dossiers to train models.
13. Liability
Digimo is bound by an obligation of means. Its liability towards the Customer, all causes combined, is limited to the amount paid by the Customer over the twelve months preceding the event giving rise to it. Digimo is not liable for indirect damage: loss of a sale, of revenue, of clientele, of reputation, nor for the consequences of an erroneous fact used without verification, nor for a use of the Service contrary to section 8. Nothing here limits Digimo’s liability for gross negligence or wilful misconduct, nor any liability the law forbids limiting.
14. Confidentiality
Each party keeps confidential the other’s non-public information learnt through the contract. The Customer’s Dossiers are confidential; Digimo accesses them only to provide the Service, the support the Customer asks for, or for security; the changes it makes to its catalogue of checks are logged with their author.
15. Changes to the terms
Digimo may change these terms. The new version is published on this site with its date, and announced by email to each Team’s owner at least one month before it takes effect for running subscriptions. Continuing to use the Service after that date is acceptance; a Customer who refuses may terminate before.
16. Governing law and jurisdiction
These terms are governed by French law. Any dispute about their formation, performance or interpretation is submitted, after an attempt at amicable settlement, to the commercial court (tribunal de commerce) of Nantes, including for interim relief and where there are several defendants.
